The City Council will require transparency measures to local public companies (28/10/2015)

The government team has proposed for the November plenary a proposed agreement on the extension of transparency to foundations, public companies, local corporations and public sector partnerships to subscribe agreements with the City of Cieza.

The initiative seeks to transfer the agreement to the boards of directors and boards of foundations, public companies and public sector corporations in which it participates Cieza City Council to take the relevant agreements in the exercise of its powers to include their processes of recruitment advertising criteria, either on its website or in the Hall, competition, transparency, confidentiality, equality and non-discrimination.

Similarly, all the associations and organizations that convenien with the Municipality of Cieza to publish the annual statement of accounts, either on its website or in the consistory will be encouraged.

Municipal sources indicate that the substance of the proposal is based on Law 19/2013, of December 9, Transparency, Access to Public Information and Good Governance, which aims to broaden and strengthen the transparency of public activity, fair and guarantee the right of access to information relating to that activity and establish good governance obligations to be met by public officials.

As explained, the law publication requirements affecting public bodies to ensure transparency in its activity and regulates the right of access of citizens to public information.

Specifically, Article 2.1 establishes a long list of institutions and bodies to be applicable the provisions of Title I, including autonomous agencies, public companies, corporations are (with capital involved local superior to 50% ) and foundations, all of the local public sector.

In Chapter II, which speaks of active advertising, specifies a number of obligations for these subjects disseminate certain information without waiting for a specific application managed.

That is, do the "motu proprio".

The general principles on which to base this active advertising of local authorities, its agencies, etc., are set out in Article 5 of the LTAI, and refer, in short, that the relevant information is published to ensure transparency activity and functions of these entities, etc., and allow control.

This publication should be made periodically and updated.

On the other hand, the regime of transparency obligations is regulated in the minimum LTAI character, so it is likely to be enhanced by a broader one that would establish regional regulations.

Similarly, the dissemination of information subject to transparency obligations should be made in the relevant electronic sites or Web pages of the company, etc., and should be clearly structured and understandable for stakeholders;

access is easy, understandable (in appropriate format) and free, and will be available to people with disabilities.

Finally, this kind of advertising will apply the limits to the right of access to public information under Article 14 of the LTAI and especially also the limit relating to the protection of personal data that is collected in Article 15 thereof.

In the latter case, when the information contained sensitive data, advertising will only take place once unlinked (removed) them.

In the spirit of the Basic Statute of Public Employees, the selective processes must be guided by the principles of publicity, competition, transparency, confidentiality, equality and non-discrimination.

Added the sources cited, on the other hand, that in another level of commitment, the City of Cieza agreed with many associations and organizations of all kinds with which establishes considerations contained in those agreements and why are normally paid one amounts commitments to subscribe.

Regardless of the documentary evidence required by the City Council for payment of the amounts signed, it is equally desire of the government team in all agreements include a commitment to transparency.

Current status of foundations, public companies and local corporations

The analysis in the visits to Aguas de Cieza and Business Promotions, the government team has observed that there are no established mechanisms of recruitment that can be likened to that used by the State and "it is necessary to establish the boards, especially in advertising matter, processes for citizens of Cieza eligible for selection systems. The need for transparency of such processes increases today with the demand for increasingly critical society with government. It is watching you even companies with 100% private capital set to their Websites sections that advertise their jobs, determine the rules of the call, open the process up to the limits allowed by law for the protection of data and determine what will be clearly the selection criteria and weighting of merit.
