Saorín, Councilor for Housing of the City of Cieza breaks down Royal Decree-Law 11/2020, of March 31, which adopts urgent measures regarding evictions, leases, mortgages and other debts other than mortgages.
The BOE of April 1, 2020 published Royal Decree-Law 11/2020, of March 31, by which complementary urgent measures are taken in the social and economic field to deal with Covid-19.
In a press release, the councilor for Housing of the City of Cieza, Francisco Saorín, explained the content of this new package of measures to support the most vulnerable families and groups, which, after the stoppage of much of the activity economic, have affected their income and, consequently, their ability to meet the expenses necessary to maintain their homes.
Regarding evictions, Saorín has specified that the royal decree-law includes the suspension of the eviction procedure and the launches for vulnerable homes without housing alternatives, due to the effects of Covid-19, for a maximum period of 6 months. , from April 2 to October 2, 2020.
Likewise, it includes the lease contracts of the habitual residence within the period from the entry into force of this royal decree-law until the day in which two months have elapsed since the end of the state of alarm, the end of the extension of the contracts , will be extended for 6 months.
Also, the Councilor for Housing has broken down what refers to the moratorium on the rental debt, pointing out the possibility of temporary and extraordinary deferment in the payment of rent or total or partial cancellation when the landlords are large holders and companies or public housing entities .
In the event that there is no agreement, the lessee will be able to choose between a reduction of 50% of the rental income during the duration of the state of alarm decreed by the Government and the following monthly payments with a maximum term of 4 months in any case, and a moratorium on the rental rent that will be applied automatically, also without being able to exceed 4 months in any case.
In the event that lessors are natural persons other than the above, the tenant may be requested in a vulnerable situation, within one month from 04/02/2020, the temporary and extraordinary delay in payment of the rent, or total or partial remission, in the same previous terms.
In this sense, Saorín has specified that the situation of vulnerability refers to those who prove the requirements provided for in article 5 of Royal Decree-Law 11/2020, of March 31: legal situation of unemployment, cessation of activity of workers for own account.
Finally, the councilor for Housing of the City of Cieza has stressed that in the case that if once the payment of the rent has been deferred, the tenant cannot face the contracted debt or if I have requested a credit to pay it and cannot return it, the art.
10 of the royal decree-law defines a new aid program, the amount of which will be up to 900 euros per month and up to 100% of the rental income or, where appropriate, up to 100% of the principal and interest on the loan that You have subscribed with the payment of the rent of the habitual residence.
